Child support orders apply to any child under the age of 18, or a child who is still attending high school or an equivalency program but ends at the age of 19 regardless.
Although, if a child is mentally or physically handicapped, the judge may order that support payments continue indefinitely, past the age of majority.
Once the youngest child is no longer a minor, child support needs to
end and stop from being withheld from the paying parent's wages.
In order to quash the Income Withholding Order and stop the child support payments from being withheld and processed, the employer will require an order from the court. If both parties are willing to sign an agreement that the child support should end and no arrearages or past out of pocket medical, dental or vision debts are owed one until the other, there is a simple form that can be completed, signed by both parties and submitted to the court for completion. If one of the parties does not agree, a Petition to Stop (or Modify) an Income Withholding Order will need to be filed and processed.
